Our commitment to protect your privacy

We understand how important it is to protect your personal information. This document sets out our privacy policy commitment in respect of personal information we hold about you and what we do with that information.

We recognise that any personal information we collect about you will only be used for the purposes for which we have collected it, or as allowed under Australian law. It is important to us that you are confident that any personal information we hold about you will be treated in a way that ensures its protection.

Our commitment in respect of personal information is to abide by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) and any other relevant law.

What information do we collect?

We collect most personal information directly from you—whether in person, by phone, electronically, or if you deal with us in some other way.

When we refer to personal information we mean information or an opinion from which your identity is reasonably apparent. Typically, this may include:

  • Credit-related information – details used to assess your eligibility for finance, including any finance you have outstanding, your repayment history, and any defaults. Credit information is usually exchanged between credit providers and credit-reporting bodies.

  • Identification information – your name, date of birth, contact details, occupation and any other information we may need to identify you. If we collect government identifiers (e.g. your Tax File Number) we only use or disclose them as required by law.

  • Financial information – information required to make credit-related decisions, such as credit reports, bank statements, employment status, income and expenses, assets and liabilities, and loan-repayment history. We may also collect information about your dependants and co-habitants if relevant to a finance application.

  • Sensitive information – such as your health, ethnicity, religion or criminal record. We will only collect sensitive information where it is reasonably necessary and with your explicit consent.

Why we collect your information

We collect your personal information so that we can:

  1. verify your identity;

  2. assess and manage applications for products or services;

  3. provide and administer the products and services you require;

  4. conduct credit-worthiness and fraud checks;

  5. manage our risks and help identify and investigate illegal activity;

  6. research, develop and improve our products or services and your customer experience;

  7. manage our relationship with you, including dealing with feedback, disputes or enquiries;

  8. comply with our legal obligations and assist government, law-enforcement agencies or regulators; and

  9. keep you informed about finance and other products or services that may interest you (direct marketing—see below).

Direct marketing

From time to time we may use your personal information to provide you with current information about finance, other offers that may interest you, changes to our organisation, or new products or services offered by us or associated companies.

How we collect your personal information

We may collect personal information in a number of ways, including:

  • directly from you (e.g. when you provide information in application forms or via our website);

  • from joint applicants, co-applicants or guarantors;

  • when you visit our website;

  • from third parties such as social-media platforms, marketing websites, related companies, or credit-reporting bodies;

  • from your representatives (e.g. solicitors, accountants, conveyancers, builders, agents);

  • from referral partners that refer your business to us; and

  • when legally required to do so (for example, in providing credit services).

How we disclose your personal information

We may disclose your personal information to:

  • banks, non-bank lenders and other providers of credit, financial or insurance services;

  • organisations involved in managing or administering your finance (e.g. third-party suppliers, printing and postal services, call centres);

  • associated businesses that may wish to market products to you;

  • information-technology and infrastructure-service providers;

  • anyone who represents you, such as finance brokers, lawyers or accountants;

  • anyone to whom you have authorised us to disclose it;

  • law-enforcement agencies, regulators or other parties where required or authorised by law (e.g. under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth));

  • investors, agents or advisers, or any entity that has an interest in our business; or

  • your employer, referees or identity-verification services.

Before disclosing your personal information, we take reasonable steps to ensure the recipient has a privacy commitment at least equal to our own, or that you have consented to the disclosure.

Transfer of information overseas

Some of the organisations to which we disclose personal information may be located outside Australia (including, but not limited to, New Zealand, the Philippines and the United States). We take reasonable steps to ensure overseas recipients do not breach the privacy obligations relating to your information. Your data may also be stored in cloud facilities accessible from various countries.

How do we hold and protect your information?

We strive to maintain the reliability, accuracy, completeness and currency of the personal information we hold and to protect its privacy and security. We keep personal information only for as long as is reasonably necessary for the purpose for which it was collected or to comply with legal or document-retention requirements.

Information we collect is initially kept in working files, which are then imaged and stored electronically; any paper is securely destroyed. Where physical archiving is required, we use Australian storage providers regulated by the Privacy Act.

We protect your information through physical security (locks, restricted premises) and electronic safeguards (firewalls, user IDs and passwords).

Will we disclose the information we collect to anyone else?

We do not sell, trade or rent your personal information. We may provide information to contractors who supply services to us (e.g. mailing houses or external data-storage providers) but only if they agree to protect your information as required under the Privacy Act.

Accessing, updating or correcting your information

You may request access to — or correction of — the personal information we hold about you at any time. Please email your request to our Privacy Officer at admin@bgbcapital.com.au or write to Privacy Officer, Level 6, 307 Queen Street, Brisbane QLD 4000.

We do not charge for receiving an access or correction request. If fulfilling a complex request will involve considerable time, we will advise you of any cost before proceeding. In limited circumstances we may refuse access or correction; if so, we will tell you why.

Complaints

If you believe we have breached the Privacy Act or this Privacy Policy in handling your personal information, please email admin@bgbcapital.com.au or write to Privacy Officer, Level 6, 307 Queen Street, Brisbane QLD 4000.
